29 CFR  1926.451(f)(3): Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.  a) Located at Lot 22-6875 Woodedge Lane, Hilliard, OH 43026: On or about February 27, 2026, the employer did not ensure the frame scaffold on the residential construction site was inspected by a competent person in that it was not fully planked, mud sills and base plates were not present, and fall protection was not installed. As a result, employees were exposed to fall heights greater than 16 feet.

29 CFR  1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  a) Located at Lot 22-6875 Woodedge Lane, Hilliard, OH 43026: On or about February 27, 2026, the employer did not ensure employees were protected from falling while working on a frame scaffold. 29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a) Located at Lot 22-6875 Woodedge Lane, Hilliard, OH 43026: On or about February 27, 2026, the employer did not ensure the ladder's side rails extended 3 feet above the landing surface nor was the ladder secured with a grasping device for employees who accessed frame scaffold on a residential construction site. Employees utilized a step ladder that was not extended beyond the scaffold's surface. As a result, the employees were exposed to falls from more than 6 feet.
