29 CFR  1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a)Dietz Co Inc., 1750 State Route 34 Wall Township, NJ 07727: Employees who operated the Yale propane forklift (Model GLFC040AFNUAE082 Serial Number A809N06845V) were not trained per the requirements of the standard, on or about 2/27/2026.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which described how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) would be met:  a) Dietz Co Inc., 1750 State Route 34 Wall Township, NJ 07727: On or about 2/27/26, the employer did not develop and implement a hazard communication program to include all the provisions in 29 CFR 1910.1200(e)(1). Assemblers were required to work with hazardous chemicals including but not limited to Alcohol and Acetone.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
