29 CFR  1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  At the production department located at 505 W 77th Str. Horton, Kansas, employees engaged in forklift operation activities were exposed to struck-by hazards in that forklift training had not been completed for the forklift operators to include formal instruction and practical training.

29 CFR  1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying  chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  At the production department located at 505 W 77th Str. Horton, Kansas, employees engaged in machining activities were exposed to struck-by and amputation hazards in that machine guarding were not provided and utilized in the following instances:  a)    Chamfer Machine b)    Gleereman Drill Press  c)     Reeves Threader , no guard over the left spindle. d)   Warner & Swasey No. 12 Tapping & Threading Machine e)    Clausing Spindle Drill Press

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  At the workplace located at 505 W 77th Str. Horton, Kansas, the employer failed to develop and implement a written hazard communication program to describe how the program would be implemented to include training, labeling, and the administration of safety data sheets, to address their hazardous chemicals used onsite. Chemicals used include but not limited to mineral spirits solvent and gasoline which are both flammable substance as well as and inhalation, skin contact and ingestion hazard .

The hazardous chemicals used include but not limited to mineral spirits solvent and gasoline,  which may cause serious health effects, and is harmful if swallowed, toxic if inhaled and harmful if in contact with skin.

Hazards associated with this chemicals include but not limited; harmful if swallowed, toxic if inhaled, harmful if in contact with skin, and may cause an allergic skin reaction.
