29 CFR  1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):  On or about 23 February 2026, Rainbow Painting Company was taping drywall on a new residential structure under construction at 410 Yellow Rose Court, Lot 128 in Wentzville, Missouri.  An employee was exposed to an approximate 12-foot fall hazard as he worked from a scaffold that did not have the working level fully planked.

29 CFR  1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.  On or about 23 February 2026, Rainbow Painting Company was taping drywall on a new residential structure under construction at 410 Yellow Rose Court, Lot 128 in Wentzville, Missouri.  Employees were exposed to fall hazards as the employer failed to inspect the mobile scaffold and components for defects by a competent person prior to beginning work. The working level of the mobile scaffold was not fully planked, planks were not secured from displacement, and no fall protection system was utilized by an employee while working on a scaffold platform at a height of approximately 12-feet above the lower level.

On or about 23 February 2026, Rainbow Painting Company was taping drywall on a new residential structure at 410 Yellow Rose Court, Lot 128 in Wentzville, Missouri. The scaffold system in use was not erected by an employee adequately trained nor while under the supervision and direction of a competent person. The working level of the mobile scaffold was not fully planked, planks were not secured from displacement, and no fall protection system was utilized by the victim while working at a height of approximately 12-feet above the lower level.

29 CFR  1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  Rainbow Painting Company was taping drywall on a new residence under construction at 410 Yellow Rose Court, Lot 128 in Wentzville, Missouri. The employer failed to report within 24-hours a work-related incident that resulted in an in-patient hospitalization. An employee sustained injuries and was hospitalized for treatment after falling from a scaffold on 02/23/2026 and not reported until 02/27/2026.
