29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about March 5, 2026, the employer did not ensure that employees operating a Hyster 45XM lift truck (45), a Yale GLC040 forklift (40), and a Yale GLC050 forklift (60) had successfully completed the required training and evaluation to demonstrate competency prior to operating the equipment. Employees were permitted to operate PITs during normal warehouse operations without documented training and evaluation. As a result, employees were exposed to hazards associated with powered industrial truck operations, including struck-by, crushing, tip-over, and caught-between hazards.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating conditions: On or about March 5, 2026, the employer did not ensure that a Hyster 45XM lift truck (45) was removed from service when it was not in safe operating condition. Specifically, the service brakes were defective in that the brake pedal had to be depressed fully to the floor to stop, resulting in delayed stopping. Employees continued to operate the forklift during normal warehouse operations despite the defective condition, exposing them to struck-by and crushing hazards due to the increased stopping distance.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. On or about March 5, 2026, the employer did not ensure that powered industrial trucks were examined prior to being placed in service to identify conditions affecting safe operation. Employees operated a Hyster 45XM lift truck (45) with defective service brakes that required the pedal to be fully depressed to stop. Pre-shift inspection records indicated the braking system was operating normally. Employees were exposed to struck-by and crushing hazards.
