29 CFR 1910.132(d)(1):The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall: (i) Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment; (ii) Communicate selection decisions to each affected employee; and, (iii) Select PPE that properly fits each affected employee. On or about March 5, 2026 at an establishment located at 2082 Old Martin Road, De Pere, WI, the employer did not sufficiently assess the workplace to determine if hazards were present, or likely to be present, which necessitated the use of personal protective equipment (PPE) while conducting sanitation activities. Such PPE includes, but is not limited to, chemical resistant gloves and splash proof eye wear when employees are exposed to chemical burn hazards.

29 CFR 1910.133(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. On or about March 5, 2026 at an establishment located at 2082 Old Martin Road, De Pere, WI, employees conducting sanitation activities with caustic chemicals were not protected from potential eye injuries associated with chemical burns when the use of splash proof eye protection was not required during these activities.

Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. On or about March 5, 2026 at an establishment located at 2082 Old Martin Road, De Pere, WI; the employer did not ensure that employees working with hazardous chemicals in the workplace, such as but not limited to ChemStation Foaming Chlorinated Caustic Cleaner (3022), ChemStation Sodium Hydroxide based Cleaner (5543) and ChemStation Chlorsan 12.5%, were provided information and training on the hazardous chemicals, exposing employees to chemical hazards such as skin and corneal burns.
