29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation. a) On the site located at the corner of Tropicana Parkway and NW 22nd Avenue, Cape Coral, FL: On or about 03/02/2026, the employer exposed an employee to cave-in hazards, in that, employees were working in an excavation that had water accumulating in the bottom of it and were not using a pump to remove it.
