29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used: (a) Under-construction apartment complex, southwest side; On or about March 9, 2026, employees accessed and exited multiple levels of a four-tiered fabricated walk-through frame scaffold system, at heights of up to approximately 20 feet, 6 inches above ground-level, by climbing the corners of end frames that were not designed for access. The employer did not ensure that a safe, approved means of access, such as an attachable ladder, integrated ladder end-frame, or alternative access method, was provided.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: (a) Under-construction apartment complex, southwest side; On or about March 9, 2026, employees worked from the second and third-level platforms of a four-tiered fabricated walk-through frame scaffold system at heights of approximately 14 feet and 20 feet, 6 inches above ground level, respectively, without suitable fall protection. The platforms were not equipped with guardrail systems, including top rails and mid rails, on the open ends or along the open back sides, and no other method of fall protection was utilized.
