29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Roof on Lot 37, Plano Pass, McDonough, GA: On or about March 10, 2026, the employer exposed employees to a fall hazard of approximately 11 feet to the lower ground level, in that the employer failed to ensure appropriate fall protection systems were provided to employees engaged in framing operations on the second level. b) Roof on Lot 38, Plano Pass, McDonough, GA: On or about March 10, 2026, the employer exposed employees to a fall hazard of approximately 11 feet to the lower ground level, in that the employer failed to ensure appropriate fall protection systems were provided to employees engaged in framing operations on the second level.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) Roof on Lot 37, Plano Pass, McDonough, GA: On or about March 10, 2026, the employer exposed employees to fall hazards of approximately 13 feet to the lower ground level, in that employer failed to ensure ladders used to access the roof of the structure were extended at least three feet above the upper landing surface.
