29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a) On or about March 9, 2026, the employer failed to instruct employees in the regulations applicable to their work environment regarding the use of approved fork-mounted attachments on an all terrain forklift (ATF). An employee was observed hoisting demolition material from the 4th floor of the Gateway building using a job-made plywood trash hopper, secured to the forks of a JLG Skytrak ATF with a 5/8" chain and a 3" Husky ratchet strap, a practice prohibited by the manufacturer's Operations & Safety Manual. As a result, employees were exposed to struck-by and crushed-by hazards.

29 CFR 1926.602(c)(1)(ii): No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced. a.) On or about March 9, 2026, the employer failed to get written approval from the ATF manufacturer in the use of a modified trash hooper made of 2x4's and plywood as the employer removed demolition material from the projects rooms located on the buildings fourth floor, in that the employer exposed employees to crushed-by, struck-by hazards from a fabricated trash hooper made of 2x4's and plywood.
