OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and crushed-by hazards where a forklift did not have a seatbelt. A) Shop area: On or about 3/11/2026, the employer exposed employees to struck-by and crushed-by hazards, in that an employee was allowed to operate a Komatsu Forklift Model FG250-12 serial number 513915 that did not have a seatbelt.
