29 CFR 1926.451(f) Use. (3): Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.  a) On March 12, 2026, the employer failed to ensure that scaffolds and scaffold components were inspected for visible defects by a competent person before each work shift in that the scaffolding in use was missing mid  guardrails, toe boards and and end caps. As a result, one employee performing siding work from the ladder-jack scaffold, were exposed to a fall hazard. The fall height was measured to be approximately 14'.

29 CFR 1926.451(g) Fall Protection. (1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.   a) On March 12, 2026, the employer failed to ensure that employees used a fall protection system while performing siding work on a residential structure. As a result, one employee was exposed to a fall hazard of approximately 14' while installing siding without a fall protection system while working on a ladder-jack scaffolding system.

29 CFR  1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:  (1) The nature of any electrical hazards, fall hazards and falling object hazards in the work area; (2) The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used; (3) The proper use of the scaffold, and the proper handling of materials on the scaffold; (4) The maximum intended load and the load-carrying capacities of the scaffolds used; and (5) Any other pertinent requirements of this subpart   a) On March 12, 2026, the employer failed to ensure that employees performing siding work on a ladder-jack scaffold were trained by a qualified person to recognize and minimize hazards. Specifically, employees were not trained on the requirement for fall protection when working on a scaffold at heights and the requirement for fall protection systems. An employee was exposed to a fall hazard of approximately 14'.
