29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:  (a) South side of commercial building; On or about March 11, 2026, employees accessed and exited a scaffold platform, located approximately 9-feet above ground-level, by climbing the corner framework of an A-1 brand canopy frame scaffold system as the employer did not ensure that a safe, approved means of access, such as an attachable ladder, integrated ladder end-frame, or alternative access method, was provided.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:   (a) Commercial building rooftop, various locations; On or about March 11, 2026, fall protection systems were not used while employees were engaged in commercial reroofing operations on a low-slope roof that was approximately 50-feet wide by 140-feet long and where edges were up to approximately 13-feet, 3-inches above the ground.

29 CFR  1926.502(h)(1)(v): The safety monitor had other responsibilities which could take the monitor's attention from the monitoring function:   (a) Commercial building rooftop, various locations; On or about March 11, 2026, the employer's designated safety monitor, assigned to oversee employees who were engaged in commercial reroofing operations on a low-slope roof that was approximately 50?feet wide by 140?feet long and where edges were up to approximately 13?feet, 3?inches above the ground, was engaged in work tasks that diverted attention away from continuous monitoring of employees working near the unprotected edges, rendering this method of fall protection ineffective.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  (a) South side of commercial building; On or about March 11, 2026, employees accessed and exited the rooftop by climbing a folded Werner brand 4-foot fiberglass stepladder that was placed on the platform of a canopy frame scaffold system. The stepladder was not used for the purpose for which it was designed (open and locked), exposing employees to fall hazards.
