29 CFR  1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  On or about March 3, 2026, the employees working in a trench were not provided hard hats when overhead hazards were present, exposing employees to struck-by hazards.   Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.  On or about March 3, 2026, employees working in a trench greater than 4 feet deep were not provided a safe means of access (ladder), exposing employees to the hazards associated with no safe access to a trench.    Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:  On or about March 3, 2026, employees working in an unprotected trench at depths ranging from 5-7 feet were not protected from a cave-in by a protective system, exposing employees to struck-by and caught in hazards.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.1153(c)(1): Specified exposure control methods. For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  On or about March 3, 2026, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified in Table 1 of paragraph (c)(1), exposing employees to respirable crystalline silica when dry cutting concrete sidewalks.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
