29 CFR 1910.178(l)(1):  This provision is applicable to construction employment by 29 CFR 1926.602(d).    29 CFR  1910.178(l): Operators were not trained in the safe operation of powered industrial trucks.  On or about March 24, 2026, employee(s) engaged in residential framing operations located at 1128 Cuzzins Street., Columbus, Nebraska. Employee(s) were exposed to struck-by  and caught between hazards in that employee(s) were operating a powered industrial truck without being trained per this subpart.

29 CFR  1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  On or about March 24, 2026, employee(s) engaged in residential framing operations located at 1128 Cuzzins Street., Columbus, Nebraska. Employee(s) were exposed to electrical shock and fall hazards in the following but not limited to instances:  1.  Powered industrial truck being utilized by untrained employees.  2.  Flexible extension cords frayed and lacked strain relief when powering equipment.  3.  Contractors on site working from platform not secured to forklift with fall protection.

29 CFR  1926.405(g)(2)(iv): Strain relief. Flexible cords shall be connected to devices and fittings so that strain relief is provided which will prevent pull from being directly transmitted to joints or terminal screws.  On or about March 24, 2026, employee(s) engaged in residential framing operations located at 1128 Cuzzins Street., Columbus, Nebraska. Employee(s) were exposed to electrical shock and burn hazards in that a damaged flexible (extension) cord was not connected to devices and fittings in a manner that prevented strain relief . The cord in question was being used to power tools and equipment.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system.  On or about March 24, 2026, it was observed that employee(s) engaged in residential framing operations located at 1128 Cuzzins Street., Columbus, Nebraska. Employee(s) were exposed to fall hazards in that the employer had employee(s) working at heights greater than 25-feet without any form of fall protection in place.

On or about March 24, 2026, it was observed that employee(s) engaged in residential framing operations located at 1128 Cuzzins Street Columbus, Nebraska. Employee(s) were exposed to fall hazards while working from a platform that was not attached to the forks of the power industrial truck.

29 CFR  1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  On or about March 24, 2026, the employer failed to provide written certification upon request that  employees were provided training on fall protection prior to working at heights.
