29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) Jobsite at or near 90-95 Snow Lane., Downingtown, PA - On or about October 21, 2025, the employer did not ensure that the ladder used to access the upper landing surface of the roof was extended to at least 3 feet. Employees used ladders that were not extended at least 3 feet to access the upper landing surface of the roof to gain access to the roof, thereby exposing employees to fall hazards approximately to 30 feet.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Jobsite at or near 90-95 Snow Lane., Downingtown, PA - On or about October 21, 2025, the employer did not ensure employees engaged in residential construction activities 6 feet or more above lower levels was protected by guardrail systems, safety net system, or personal fall arrest system. Employees were performing roofing activities approximately 30 feet above ground level without the use of a fall protection system. Gonzalez General Contractor LLC was previously cited for a violation of this Occupational Safety and Health Standard, which was contained in OSHA inspection number 1666152, citation number 1, item number1, and was affirmed as a final order on September 25, 2023, with respect to a workplace located at 4632 Central Ave, Ocean City, NJ.
