The employer must ensure: (i) Each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following: (A) Covers; (B) Guardrail Systems; (C) Travel Restraint Systems; or (D) Personal Fall Arrest Systems.  On and before April 29, 2026, at an establishment located at 975 E Main St , Wautoma, WI, employees moving and removing carts of sausage into, and out of, the Big pit were exposed to fall hazards of greater than four feet when there were not protected from holes on each side of the walking platform that ran the length of the smokehouse.

Employees were exposed to unexpected energization when they were cleaning equipment and did not understand which controls fully isolated all energy sources within the designated areas they were working.

On or about march 26, 2026, at an establishment located at 975 E Main St , Wautoma, WI, the employer did not conduct periodic inspections of their energy control procedures to ensure that the procedures and the requirements of this standard were followed. Employees performed servicing and maintenance tasks on equipment including but not limited to, mixer, grinders, thermo-formers and sausage cutters.

29 CFR  1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  a) On or about, March 26, 2026, at an establishment located at 975 E Main St , Wautoma, WI, employees in Kitchen 1 were exposed to machine hazards associated with moving parts when they engaged in sanitation activities on the transfer auger between the grinder and mixer.  The employer did not ensure that employees implemented energy control application steps or equivalent protective measures prior to allowing them to open the guards on the auger and begin to sanitize the line.    b) On or about, April 29, 2026, at an establishment located at 975 E Main St , Wautoma, WI, employees in Kitchen 1 were exposed to machine hazards associated with moving parts when they engaged in sanitation activities on the transfer auger between the grinder and mixer.  The employer did not ensure that employees implemented energy control application steps or equivalent protective measures prior to allowing them to open the guards on the auger and begin to sanitize the line.    c) On or about, April 29, 2026, at an establishment located at 975 E Main St , Wautoma, WI, employees in Kitchen 1 were exposed to machine hazards associated with moving parts when they engaged in sanitation activities on the dumper.  The employer did not ensure that employees implemented energy control application steps or equivalent protective measures prior to allowing them to sanitize the dumper while it was still energized.    As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine hazards.

29 CFR  1910.151(c): Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body shall be provided within the work area for immediate emergency use. [63 FR 33450, June 18, 1998]  On or about, April 29, 2026, at an establishment located at 975 E Main St , Wautoma, WI, employees working with caustic chemicals in the chemical cage were exposed to potential eye injuries such as corneal burns when the eye wash station was located outside of chemical cage and behind a storage area of chemical totes.

29 CFR  1910.212(a)(1): Machine Guarding. Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are - barrier guards, two-hand tripping devices, electronic safety devices, etc.  a) On or about March 16, 2026, at an establishment located at 975 E Main St , Wautoma, WI, in Kitchen #1, employees filling V-Mags of sausage filling mixes were exposed to caught-in hazards created by the rotating end of the outfeed auger on the Whyler Mixer Grinder when guarding was not provided to prevent access to the hazard area.   b) On or about, March 26, 2026, at an establishment located at 975 E Main St , Wautoma, WI, in Kitchen #1, Stuffing Operators were exposed to potential caught-in hazards when the pinch point between two in-rotating sausage conveyors on the stuffers was not guarded to prevent exposure.   c) On or about, March 26, 2026, at an establishment located at 975 E Main St , Wautoma, WI, in Kitchen #2, Stuffing Operators were exposed to potential caught-in hazards when the pinch point between two in-rotating sausage conveyors on the stuffers was not guarded to prevent exposure.

29 CFR  1910.1200(f)(6): Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with either: (i) The information specified under paragraphs (f)(1)(i) through (v) of this section for labels on shipped containers; or, (ii) Product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  On or about, March 26, 2026, at an establishment located at 975 E Main St , Wautoma, WI, in Kitchen #1, the employer did not ensure that a container of hazardous chemical was labeled, tagged or marked, with the  hazards of its contents, exposing an employee to chemical hazards. A bottle of Mineral Oil was not properly labeled, tagged or marked with the information required under the standard.
