29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a) Located at Building 19-5724 Bixby Rd, Canal Winchester, OH 43110: On or about March 20, 2026, the employer did not ensure that employees installing siding on the third-story patio were protected from falling by a fall protection system. As a result, employees were exposed to a fall hazard of greater than 20 feet while siding during residential construction. Ismael Construction and Siding LLC was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1695769, citation number 2, item number 1 and was affirmed as a final order on March 27, 2024, with respect to a workplace located at 2335 North Cassidy, Building 4, Columbus, OH 43219. Ismael Construction and Siding LLC was previously cited for a violation of this Occupational Safety and Health standard 1926.501(b)(13), which was contained in OSHA inspection number 1655738, citation number 1, item number 1 and was affirmed as a final order on August 1, 2023, with respect to a workplace located at 8891 Moreland Street, Powell, OH 43065.
