29 CFR  1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  A) On or about April 8th, 2026, the employer did not ensure that each employee performing media blasting and powder coating work on top of fuel tanks with unprotected sides and edges was protected from falling at minimum 8 feet and sometimes as much as 11 feet to the floor below by one or more of the systems described in 29 CFR 1910.28(b)(1)(i).   B) On or about April 8th, 2026, the employer did not ensure that each employee performing welding work on top of a fuel tank with unprotected sides and edges was protected from falling 5 feet to the floor below by one or more of the systems described in 29 CFR 1910.28(b)(1)(i).

29 CFR  1910.252(b)(2)(iii): Workers and other persons adjacent to the welding area were not required to wear appropriate goggles to protect them from the rays when noncombustible or flameproof screens or shields were not used:  On or about April 8, 2026, employees adjacent to the welding area were exposed to hazardous arc welding rays while MIG welding on mild steel was being performed and they were not protected from the rays by screens or shields and were not required to wear appropriate goggles.
