On or about April 15, 2026, located at 1571 North Main Street in Marion, Ohio, the employer did not ensure employees wore eye protection while operating Milwaukee battery-powered framing nail guns exposing employees to a struck-by hazard to the eyes.

29 CFR  1926.501(b)(1):  Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a. On or about April 15, 2026, located at 1571 North Main Street in Marion, Ohio, the employer did not ensure employees were protected from falls with the use of fall protection while walking/working from wood purlins exposing the employees to an approximate 18 to 24 foot fall hazard.  b. On or about April 15, 2026, located at 1571 North Main Street in Marion, Ohio, the employer did not ensure employees were protected from falls with the use of fall protection while climbing wood side girts in order to access the top of the building exposing the employees to a maximum fall hazard of approximately 18 feet.

29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a. On or about April 15, 2026, located at 1571 North Main Street in Marion, Ohio, the employer did not ensure employees were protected from a fall hazard of approximately 18 feet from an extension ladder that was used as access to the top of a pole building by ensuring the ladder extended at least three feet above the landing surface.
