OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls and caught-between hazards with lifting employees from an excavator bucket: a. On or about April 15, 2026, located at 840 Lima Street in Kenton, Ohio, the employer did not ensure employees were protected from a fall up to approximately 10 feet and caught-between hazards while lifting and lowering employees in and out of a trench with the bucket of a Kubota KX 040-4 compact excavator.

A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. a. On or about April 15, 2026, located at 840 Lima Street in Kenton, Ohio, the employer did not ensure employees had a safe means of egress by means of stairway, ladder, ramp or other safe means while employees worked in an unprotected trench that was 8 to 8-1/2 feet deep thereby exposing the employees to struck-by and/or caught-in hazards.

On or about April 15, 2026, located at 840 Lima Street in Kenton, Ohio, the employer did not ensure each employee was protected from trench cave-ins with a protective system while performing sewer line work in a trench that was between 8 and 8-1/2 feet deep exposing the employees to caught-in and struck-by hazards.
