29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated. a) On or about April 20, 2026, the employer failed to ensure that adequate daily inspections of the excavation were completed prior to and during the workday while performing a hot tap on a live gas line to repair a gasket, exposing employees to potential cave-in hazards due to an improperly set up cave-in protection in that the boxes were set more than two feet below the top of the excavation a trench greater than 5 feet deep.

29 CFR 1926.652(a)(1): Protection of employees in excavations. Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: 1926.652(a)(1)(i): Excavations are made entirely in stable rock; or 1926.652(a)(1)(ii): Excavations are less than 5 feet (1.52 m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in. a) On or about April 20, 2026, the employer failed to ensure that a trench box or an alternative protection system was in proper place prior to employees working in the 5 foot deep excavation in that the trench boxes were set approximately two feet below the top of the excavation, resulting in employees being exposed to cave-in hazards while working on gas line repairs near a public roadway.
