The employer is not developing nor implementing safety and health programs that provide construction hazard recognition guidelines to employees to mitigate these hazards.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section (fall protection training) by preparing a written certification record which contained the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer:  The employer is failing to protect employees from fall hazards. This was most recently documented on or about April 27, 2026, at the job site located at 8324 West Waterway Ct. Maize, Kansas. Employees engaged in residential framing activities were exposed to fall hazards of approximately 9.3 feet from the working surface of the roof to the ground below. The employer is not preparing a written certification verifying that these employees have been trained in hazards related to falls from elevation.

This was most recently observed at a jobsite located at 8324 West Waterway Ct. Maize, Kansas, where an employee engaged in residential framing activities using a cordless circular saw was exposed to struck-by hazards in that he was not using eye protection.  Guillermo De La Torre Gonzales was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1831032, citation number 1, item number 1 and was affirmed as a final order on September 22, 2025, with respect to a workplace located at 3729-3731 West 30th St. North, Wichita, KS 67205.  Guillermo De La Torre Gonzales was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1708200, citation number 1, item number 1 and was affirmed as a final order on January 23, 2024, with respect to a workplace located at 5339 N. This was most recently documented on April 27, 2026, at 8324 West Waterway Ct. Maize, KS 67101, where employees engaged in residential framing activities on an 8:12 sloped roof approximately 9.3 feet above ground level were not using any form of fall protection.  Guillermo De La Torre Gonzales was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1837918, citation number 2, item number 1 and was affirmed as a final order on September 17, 2025, with respect to a workplace located at 18460 W 21st Ct.
