29 CFR 1926.652(g)(2): Excavations of earth material to a level greater than 2 feet (.61m) below the bottom of a shield was permitted:    (a) On April 29, 2026, at or near the intersection of Hwy 21 & Millionaire Avenue in Mott, North Dakota, an employee working in a trench to expose a horizontally bored pipe was exposed to cave in hazards where the bottom of the trench shield was approximately 4 feet above the bottom of the trench.  Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1775203, Citation 1, Item 1c , and was affirmed as a final order on December 6, 2024, with respect to a workplace located at the intersection of Summit Street & West Grant Avenue in Underwood, North Dakota.
