29 CFR 1926.652(g)(2): Excavations of earth material to a level greater than 2 feet (.61m) below the bottom of a shield was permitted: (a) On April 29, 2026, at or near the intersection of Hwy 21 & Millionaire Avenue in Mott, North Dakota, an employee working in a trench to expose a horizontally bored pipe was exposed to cave in hazards where the bottom of the trench shield was approximately 4 feet above the bottom of the trench. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1775203, Citation 1, Item 1c , and was affirmed as a final order on December 6, 2024, with respect to a workplace located at the intersection of Summit Street & West Grant Avenue in Underwood, North Dakota.

29 CFR 1926.652(c)(2)(i): Design of support systems, shield systems, or other protective systems that are drawn from manufacturer's tabulated data were not in accordance with all specifications, recommendations, and limitations issued or made by the manufacturer: (a) On April 29, 2026, at or near the intersection of Hwy 21 and Millionaire Avenue in Mott, North Dakota, an employee working within a trench shield to expose a horizontally bored pipe was exposed to struck by hazards where the trench shield was not assembled with the minimum number of connector pins on all panels according to manufacturer tabulated data.
