29 CFR  1910.178(l)(1)(i):  The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  Employees were exposed to struck-by hazards.  Employee(s) using a Crown forklift to engage in material handing activities in the warehouse located at 400 Marble, Fort Scott, Kansas were exposed to struck-by hazards in that comprehensive forklift training was not completed prior to permitting the forklift operators to operate the equipment.

29 CFR  1910.1200(e)(1): The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met:  At the workplace located at 400 Marble, Fort Scott, Kansas, employees were exposed to chemical hazards due to no written hazard communication program developed nor implemented to address hazardous chemicals  such as, but not limited to sulfuric acid, floor stripper, lubricants, degreasers.

29 CFR  1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area:  At the workplace located at 400 Marble, Fort Scott, Kansas, employees were exposed to chemical hazards in that the employer did not train the employees on how to recognize, evaluate, mitigate, and control exposure to chemical hazards. Chemicals used onsite included but not limited to sulfuric acid, bleach, and lubricants.
