Employees were exposed to a fall from height of approximately 30 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On or about May 8, 2026, at a multi-unit, multi-level residential apartment building job site, which was located at 2814 Wood Duck Lane, Akron OH, the employer failed to ensure that portable ladders being used to access the upper leading edge of the residential roof, had the rungs of the ladder extended at least 3 feet/rungs above this upper access point. Employees were exposed to a fall from height of approximately 30 feet.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about May 8, 2026, the employer failed to ensure that employees who were working on the roof at a multi-unit, multi-level residential apartment building job site, which was located at 2814 Wood Duck Lane, Akron OH, were protected from a fall from height hazard of approximately 30 feet. Employees were not wearing a fall protection harness nor were there any other fall protection systems in place. All Year Roofing and Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 1926.501(b)(10), which was contained in OSHA inspection number 1660629, citation number 1, item number 1a, and was affirmed as a final order on May 16, 2023, with respect to a workplace located at 1012 Prospect Ave East, Cleveland, OH 44147.
