29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   On or about May 11, 2026, the employer failed to ensure that employees who were working on the roof of a residential home at a job site located at 1236 W. Waterloo Rd., Akron OH, the employer failed to train employees in the recognition of potential fall hazards and an effective means of prevention and protection from such.  Employees were exposed to a fall from height of approximately 25 feet.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about May 11, 2026, the employer failed to ensure that employees who were working on the roof of a residential home at a job site located at 1236 W. Waterloo Rd., Akron OH, the employer failed to ensure that portable ladders being used to access the upper leading edge of the residential roof, had the rungs of the ladder extended at least 3 feet/rungs above this upper access point.  Employees were exposed to a fall from height of approximately 25 feet.

29 CFR  1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about May 11, 2026, the employer failed to ensure that employees who were working on the roof of a residential home at a job site located at 1236 W. Waterloo Rd., Akron OH, were protected from a fall from height hazard of approximately 25 feet.  Employees were not wearing a fall protection harness nor were there any other fall protection systems in place.  Resendiz Jiminez J Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13) , which was contained in OSHA inspection number 1664759, citation number 1, item number 2, and was affirmed as a final order on July 10, 2023, with respect to a workplace located at 4452 Woodstone Ave. NW, Massillon OH 44647.
