29 CFR 1910.28(b)(3)(iv): The employer did not ensure each employee was protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toe boards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used. a) On or about 05/14/2026, Filling Room; employees were exposed to a fall hazard of approximately 5 feet when the top of the ladderway hole used to access the platform around the Industrial Starch tank was open without any protection from falling into the unguarded ladderway opening. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.29(b)(1): The employer did not ensure that guardrail systems met the requirement that the top edge height of top rails, or equivalent guardrail system members, that are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section. a) On or about 05/14/2026, in Room D, the stairs by Tank 002 had a guardrail system with the top rail measuring 22 inches, exposing employees to falling from a height of 4 feet when going on the stairs to open or close a valve when oil or wax is delivered. ABATEMENT CERTIFICATION REQUIRED
