29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) On or about May 15, 2026, and at times prior, employees were exposed to struck by hazards from working below the brick laying crew on the scaffolding, without wearing a protective helmet.

29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  a) On or about May 15, 2026, and at times prior, employees were exposed to fall hazards of 13 feet to the ground below from using the end frame of the scaffolding to access the upper levels of the scaffold.

29 CFR  1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person.  a) On or about May 15, 2026, and at times prior, employees were exposed to fall hazards from erecting and using a scaffold without the direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. The scaffold onsite was missing ladders to access the upper areas, missing guard rails on the walking working surfaces on the scaffold that were greater than 10 ft in height, and not all pieces to the scaffold were used.

29 CFR  1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity).  a) a) On or about May 15, 2026, and at times prior, employees were exposed to fall hazards of 13 feet to the ground below while working from a Fabricated Frame Scaffold without the use of a personal fall arrest system or guardrail system.
