29 CFR  1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  On or about May 19, 2026, the employer did not establish an energy control (lockout/tagout) program, consisting of energy control procedures, employee training, and periodic inspections to ensure employees were protected from injury from the unexpected energization, stat up, or release of stored energy when employees were conducting service and maintenance activities such as cleaning and sanitizing food production equipment such as; a meat mixer machine, band saws, meat grinders, sausage maker machines, etc.

29 CFR  1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.  On or about May 13, 2026, the employer failed to ensure the point of operation guarding of a Leland 100 DA Meat Mixer was in conformity with the appropriate standards to prevent operators from having any part of their body in the danger zone during the operation cycle of the dual-action paddles (point of operation) when emptying the product from the mixer machine.  The mixer machine's point of operation barrier guard, in the form of a grated metal lid, permitted the dual-action paddles to be cycled when the meat mixer's tank was tilted forward to empty product from the mixer machine, permitting the operator to have their hands and arms inside the mixer tank while the dual-action paddles were operating.
