29 CFR  1926.454(a):The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: (1) The nature of any electrical hazards, fall hazards and falling object hazards in the work area;  (2) The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used;  (3) The proper use of the scaffold, and the proper handling of materials on the scaffold;  (4) The maximum intended load and the load-carrying capacities of the scaffolds used; and  (5) Any other pertinent requirements of this subpart  a) On or about may 27, 2026, the employer failed to ensure that employees performing siding work on a pump jack scaffold were trained by a qualified person to recognize and minimize hazards. Specifically, employees were not trained on the need for proper means  of conventional fall protection. As a result, employees were exposed to fall hazards of 12 ft.

29 CFR  1926.451(f)(7):Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.  a) On or about May 27, 2026, the employer did not ensure that the pump jack scaffold was erected by a competent person, as a result employees were exposed to a fall hazard while working from the pump jack.  Silverio Morales was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(f)(7), which was contained in OSHA inspection number 1664750, citation number 1, item number 1and was affirmed as a final order on June 21, 2023, with respect to a workplace located at 5519 Pacific Crest Ln Hamilton, OH 45011.

29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  a) On or about May 27, 2026, the employer did not ensure that employees performing siding work on a residential jobsite, working from a pump jack scaffold, utilized a personal fall arrest system or guardrail system, as a result employees were exposed to a 12 ft fall hazard.  Silverio Morales was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(f)(7), which was contained in OSHA inspection number 1664750, citation number 1, item number 2 and was affirmed as a final order on June 21, 2023, with respect to a workplace located at 5519 Pacific Crest Ln Hamilton, OH 45011.
