29 CFR  1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a.) On or about March 18, 2026, located on a new residential multi-family complex the employer failed to provide frequent and regular inspections of the jobsite as employees installed handrail on the second level outside walls and as a result employees were exposed to 10'4" fall hazards as no fall protection system was installed and an extension ladder used at an angle greater then a 4-1 ratio.

29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    a.) On or about March 18, 2026, located on a new residential multi-family complex the employer failed to unsure a fall protection system was used as employees installed hand rail of the second level outside walls and as a result employees were exposed to 10'4" fall hazard.

29 CFR  1926.1053(b)(5)(i): Non-self-supporting ladders shall be used at an angle such that the horizontal distance from the top support to the foot of the ladder is approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support).    a.) On or about March 18, 2026, located on a new residential multi-family complex the employer did not ensure that ladders being used by employees for residential roofing work were set up at an angle equal to one-quarter of the working length (0.25); in that, the ladders were being used at a height of 10'4" with a base distance of 7', instead of 2.5', which is 4.5' too far out and as a result employees were exposed to 10'4" fall hazard.

29 CFR  1926.1053(b)(15): Ladders shall be inspected by a competent person for visible defects on a periodic basis and after any occurrence that could affect their safe use.  a.) On or about March 18, 2026, located on a new residential multi-family complex the employer did not ensure that ladders being used by employees for residential roofing work were inspected by a competent person for visible defects in that the manufacturer instructional labels were missing that disclosed important information for safe use the ladder and as a result employees were exposed to 10'4" fall hazard.
