Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that there were no confined
space entry program in place to ensure that the atmosphere of tank
trailers were safe prior to allowing employees to enter the vehicle.  As
a minimum, a confined space entry program shall include the following:
1) The atmosphere of the tank trailer must be tested for oxygen content,
flammable vapors and, depending on prior contents of the tank, toxic
gases and vapors.
2) Lifelines and harnesses must be used when working inside tank
trailers.
3) Employees must be trained in the health and safety hazards associated
with confined space work and must be familiar with proper entry and
rescue techniques.
4) Confined space entry procedures should include the use of a permit
system with management "sign-off" (authorization).
5) Warning signs and safety instructions must be posted in the area of
confined space entry work.
