Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to emoloyees in that employees were exposed to
multiple injuries from a fall to ground below:
a) M. J. Spott Construction Co., Inc Wilkes College Gym/Sports
Conference Center excavation at Franklin Street (between Ross and
South Streets), and employee was straddling the steel piling
approximately 20 feet in the air and being driven into the ground on
the west side of bArnum Place and to the rear of the excavation was
not provided with personal protective equipment (safety belt and
lanyard) to protect employee from accidentally falling to the ground
below and possible serious injury, March 23, 1988.
AMONG OTHER METHODS, THE FOLLOWING FEASIBLE AND
