Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
potential hazards of toxic and/or flammable atmospheres and oxygen
deficiency during tank cleaning operatings requiring tank entry:
a) Though not necessarily limited to the following, one feasible method
of abatement is to establish confined space entry procedures that
include:
1) Pre entry atmospheric testing of the confined space for oxygen
content and toxic and/or flammable gases or vapors.
2) Use of harness and safety lines
3) Use of proper ememrgency respirators
4) Use of standby employee suited in similar fashion to entry employee
