Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Tank wash employees were exposed to the hazard of asphyxiation due to the potential of an oxygen deficient atmosphere during tank cleaning operations requiring tank entry, in over the road trailers. Though not necessarily limited to the following, one feasible method of abatement is to establish and enforce confined space entry procedures. 1) Posting of written confined space entry procedures adjacent to tanks or other confined space areas which may be entered. 2) Safety harness and lifeline to be used at all times for communication between standby and person entering tank. 3) Standby employee suited in a similar fashion to the entry employee. 4) Hoisting device or other effective method to lift employee out of space in an emergency. 5) Every employee required to enter a confined space, perform standby duties, provide emergency service, give first-aid or act in rescue, shall be instructed and trained thoroughly in his particular responsibility. The Publication American National Standards Institute (ANSI) Z117.1- 1977 confined space or American Petroleum Institute (API) Publication 1013 - "Cleaning Mobile Tanks in Flammable of Combustible Liquid Service" and or N.J.A.C. 12:170 "Work in Confined Spaces," may be used as reference when developing entry procedures.
