Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) Employees were exposed to the uncontrolled lowering of two hoists in the east bay area which had defective safety latches incapable of securing the hoists in an up position. The hoists were not inspected or maintained according to ANSI B153.1 - 1974, section 6.3, safety requirements for the construction care and use of automotive lifts.
