Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of patient lifting leading to back injuries and lost work time: Location: For all personnel involved in the lifting or transportation of patients, including, but not limited to, nurses, orderlies and nurses aid. Employees are required to reqularly lift patients where the weight exceeded the maximum permissible limit (MPL) as recommended and calculated by the National Institute for Occupational Safety and Health (NIOSH) formula for employee lifting. Common lifts include lifting patients from bed to chair and vice-versa, bed to stretcher and vice- versa, and from floor to bed or chair. Among others, feasible and acceptable methods of abatement include: a) Purchase and enforce use of lifts and slide-N-Glide, where possible. b) Provide documented training records to all new hires. Training should be provided by management personnel who have themselves been properly trained. c) Investigate and perform Job Hazard Analysis of all musculoskeletal incidents and provide refresher training for employees involved. d) Provide for staffing that will allow for employees to perform lifts in teams where exposure greater than the MPL is anticipated and engineering controls are otherwise infeasible. e) Develop a mechanism whereby staff development is provided copies of all incident reports and follow-up on same.
