Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)THE HAZARD OF FALLING FROM AN ELEVATED WORK LOCATION ON THE SKY DIVER AMUSEMENT RIDE. RIGHT HAND SIDE OF MAIN MIDWAY, SKY DIVER AMUSEMENT RIDE ON OR ABOUT 08/24/95 (1) ONE EMPLOYEE WAS STANDING ON CROSS BRACING OF "A' FRAME SECTION SON SWEEP CHANGING LIGHT BULBS, NO FALL PROTECTION WAS BEING USED, EMPLOYEE WAS APPROXIMATELY 30 FEET ABOVE GROUND LEVEL. One feasible method among other methods to reduce this hazard is to use a safety belt and lanyard per the Manufactures Field Inspection and Test Guide Manual for the Sky Diver amusement ride, pg. 20, General Safety Guidelines, Item #4.
