Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
fall of up to 55 feet:
a) On October 27, 1986, a multi-stage suspension scaffold was in use
during construction of Plant #2, Chrysler Corp., Fenton, Missouri.
The scaffold was located near the northwest corner of Plant #2,
suspended from the roof outside. It contained three (3) stages each
sixteen (16) feet in length, the top stage level height being sixty-
two (62) feet from the ground. The distance between the stages was
seven (7) feet. Guardrails consisted of one (1) top rail of square
metal tubing, approximately sixteen (16) feet in length, tied onto
the scaffold with #9 wire at each end. One (1) employee was on each
stage level. Employees were placing sheet metal siding on the
building. Neither of the employees on the two (2) lower stage levels
was protected from falling.
One feasible and acceptable method of abatement is for the employee(s)
on the lower two (2) stages to wear safety belts attached to a suitable
member of the scaffold structure.
