Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from not being restrained in a forklift in case of collision tipping and/or rollover: a)On 03/27/06 an employee was operating a TOYOTA forklift Number 122FG and was not wearing his seatbelt. ABATEMENT NOTE: AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO WEAR THE PROVIDED SEATBELT AS REFERENCED IN ITSDF B56.1-2005 "SAFETY STANDARD FOR LOW LIFT TRUCKS" OR FOLLOW THE OPERATOR MANUAL UNDER THE USE OF SEATBELT.
