Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from an unintended activation of the foot pedal not protected by the guard: Among other methods, one feasible and acceptable abatement method to correct this hazard is to replace the missing foot pedal guard. OR IN THE ALTERNATIVE 29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operators and other employees from hazards created by pinch point: (a) Shop - Employees operate a Sheritt and Stoer Company set of five (5) inch rollers to roll metal plagte. No means was provided to protect the foot pedal from unintended activation by falling or moving objects or by someone accidently stepping on it, on or about January 20, 1993.
