Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) At the construction site located at 601 West 57th Street for an employee working in the basket of a boom supported elevating work platform without benefit of fall protection. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the requirements set forth in ANSI A92.5-1992 for Boom Supported Elevating Work Platforms: Part 8 Responsibilities of Operators: Paragraph 8.8g: Ensure all personnel in the platform are wearing fall protection devices and other safety gear as required at all times.ed
