Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) For employees operating the freight elevator where the elevator operating capacity was not identified exposing employees to a potential for injury. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the requirements set forth in ANSI/ASME A17.1-1984 Rule 207.3a: Every elevator shall be provided with a capacity plate and a data plate permanently and securely fastened in place. The capacity plate shall be conspicuously positioned inside the car. For freight elevators the load rating shall be based on not less than 50 lb/square ft. Among other methods, one feasible and acceptable method to correct this hazard is to follow the requirements set forth in ANSI/ASME A17.1-1984 Rule 207.5: Signs Required in Freight Elevator Cars: Rule 207.5a (2): For elevators not permitted to carry passengers, the sign shall read: "THIS IS NOT A PASSENGER ELEVATOR, NO PERSONS OTHER THAN THE OPERATOR AND FREIGHT HANDLERS ARE PERMITTED TO RIDE ON THE ELEVATOR". Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the requirements set forth in ANSI/ASME A17.1-1984 Rule 210.2 (e): Emergency Stop Switch: An emergency stop switch shall be provided in the car and located in or adjacent to each car operating panel. When opened, this switch shall cause the electric power to be removed from the elevator driving machine motor and brake. Tops of car enclosures shall be so designed and installed as to be capable of sustaining a load of 300 lb (136 kg) on any area 2 ft (610 mm) by 2 ft (610 mm) and 100 lb (45 kg) applied at any point.
