Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees, in that: There was no protection for employees working inside the manhole, and employees were not kept out of the manhole while installing fiber optic support structures and pulling mandrel through a 4" PVC pipe, exposing employees to the hazard of crushing head injuries and/or death from contact with wall of precast concrete. Among other methods, one feasible method of abatement would be removing employees from the manhole. The employer did not ensure employees were out of the manhole during the pulling operation.
