Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Employees lifting loads with specialized lifting devices such as die baskets, spreader bars, and billet tongs suspended from overhead cranes and hoists were exposed to the hazard of being struck by falling loads in that the lifting devices were not proof tested and marked with their rated load capacity. One feasible and acceptable method, among others, to correct this hazard would be to proof test the lifting devices, and mark them with a rated load capacity to ensure that the devices are not loaded beyond their rated capacity.
