Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Employees, were exposed to the hazard of being struck by loads, or loads falling falling from hoists, due to unlabeled pendant control functions, damaged or mismatched hoist components, and unmarked or erroneously marked hoist component capacities. Hoists included: A. The small shake out hoist which had unmarked pendant control functions, no rated load capacity marking visible from the operator's station, a damaged hoist rope, a damaged sheave in it's load block, no upper limit switch, and a damaged rope keeper on it's load block. B. The David Round and Son hoist at the side floor molding area which had a 1 ton hoist suspended from a Demag carrier with a 600 kg capacity. C. The hoist suspended from a beam between presses in the shipping department which was marked with different capacities on either side of the hoist beam. Among others, one feasible and acceptable method to correct this hazard would be to institute an inspection and maintenance program complying with ANSI B30.16, The American National Standard for Underhung Hoists, which requires unsafe conditions disclosed by hoist inspections be corrected by adjustment, repair, or replacement before continuing the use of the hoist.
