29 CFR 1910.1000(c): Employees were exposed to silica (respirable dust), listed in Table Z-3, in excess of 0.653 milligrams per cubic meter of air, as an 8-hour Time-Weighted Average concentration: On March 27, 2012, a Ladle Man was exposed to respirable dust containing silica while repairing and cleaning the ladles and furnace, at a level of 0.9 milligrams per cubic meter of air as an 8-hour Time-Weighted Average, during a sampling period of 480 minutes, which was 1.37 times the Permissible Exposure Limit of 0.653 milligrams per cubic meter of air based upon 13.3% of the sample containing silica. This employer was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1910.1000(c) which was contained in OSHA inspection number 313011876, citation number 2, item number 2a, issued on October 16, 2009, which became a final order on November 10, 2009 through a stipulated settlement agreement.

29 CFR 1910.1000(e): To achieve compliance with paragraphs (a) through (d) of this section, administrative or engineering controls must first be determined and implemented whenever feasible. When such controls are not feasible to achieve full compliance, protective equipment or any other protective measures shall be used to keep the exposure of employees to air contaminants within the limits prescribed in this section. Any equipment and/or technical measures used for this purpose must be approved for each particular use by a competent industrial hygienist or other technically qualified person. Whenever respirators are used, their use shall comply with 1910.134: The employer did not implement engineering/administrative controls for the employee that repairs and cleans the furnace and ladles, to reduce and maintain the employee exposure to silica (respirable dust) below 0.653 milligrams per cubic meter of air, without respect to the use of respirators, in that an employee was exposed at 1.37 times the Permissible Exposure Limit for silica (respirable dust) during a sampling period of 480 minutes on March 27, 2012. This employer was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1910.1000(e) which was contained in OSHA inspection number 313011876, citation number 2, item number 2b, issued on October 16, 2009, which became a final order on November 10, 2009 through a stipulated settlement agreement.
