Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Located along the interior center aisleway, employees were exposed to the hazards associated with falls in excess of 8 feet and the potential of being struck by a falling Bil- Jax XLT-Cat 23 aerial platform while working or moving the platform. Among other methods feasible and acceptable to correct this hazard are but not limited to, extending and stabilizing all outriggers, positioning mid rail chain, and not moving extended lift with persons on board.
