Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of explosion and fire from the rotary kiln, due to the absence of a functioning auto pilot/ignition control means, in that: (a)Employees had to light the burner for the kiln by manually opening the gas line valves and lighting either newspaper or a soaked rag on the end of an extension rod. Among other methods, one feasible and acceptable method to correct this hazard is to install a functioning auto pilot/ignition control means, in accordance with the requirements of the NFPA 86B for Industrial Furnaces.
